Simons Water Rentals – Summary of Terms and Conditions
Services Offered
Simons Water Rentals provides automatic 5-door vehicles with unlimited kilometres. Free delivery and sign-up are available at your accommodation or the airport. Baby and booster seats can be requested at no extra cost. Vehicles may be returned at the airport or any preferred location on departure day. There are no hidden charges—renters only pay for the petrol they use.
Cancellation and Modification Policy
Cancellations made 14 days or more before arrival receive a full refund (less fees).
Cancellations made within 14 days of arrival receive a 50% refund (less fees).
Cancellations made within 7 days of arrival are non-refundable.
Modifications made 14 days or more before arrival are allowed free of charge.
Modifications within 14 days of arrival are subject to availability and approval. If changes result in cancellation, no refund will be issued.
No modifications are permitted within 48 hours of arrival.
Rental Requirements
Renters must be at least 21 years old and hold a valid full driver’s licence for over one year.
The licence must be valid for the vehicle class and recognised on Norfolk Island.
Renters must not have convictions for driving under the influence or refusal of motor vehicle insurance.
A credit card imprint is required on arrival as security.
A $1,000 hold will be placed on the credit card provided, serving as security for the accident excess. This hold will be released after the vehicle is returned in acceptable condition.
Accident excess is $1,000, which can be reduced to $0 for $17 per day. Travel or credit card insurance may also cover this.
Vehicle Use and Responsibilities
Only authorised drivers listed on the rental agreement may drive the vehicle.
Driving under the influence of alcohol or drugs is strictly prohibited.
Vehicles must not be used for illegal activities, racing, towing, or carrying passengers or loads beyond design limits.
Use for passenger transport for reward or other unauthorised purposes is prohibited.
Vehicles must be driven only on sealed roads.
Vehicles must be returned in acceptable condition, allowing for reasonable wear and tear.
Smoking and pets are not permitted in the vehicle.
A cleaning fee of $100 will apply if the vehicle is returned in an unreasonably dirty condition.
All accidents, incidents, or damage must be reported in writing within 24 hours.
Renters must provide all requested information and report any personal injury incidents to the insurer.
No admissions of liability or settlements may be made without the hirer’s written consent. Renters are responsible for any unauthorised settlements.
Reasonable Wear and Tear
Reasonable wear and tear refers to minor deterioration consistent with normal use. Examples include light road dust or surface grime, minor scuffing to tyres or floor mats, small stone chips or superficial marks not affecting function or safety, and normal fading or wear to upholstery from sun exposure.
Unacceptable wear and tear includes cracked or broken parts, stains, tears, or burns to upholstery, dents, scratches, or damage beyond superficial marks, and evidence of off-road use or misuse.
Repossession and Breach
The hirer may terminate the agreement and repossess the vehicle without notice if any terms or warranties are breached, or if the renter’s behaviour is likely to endanger the vehicle or the hirer’s interests. Vehicles must be returned as specified—location, date, and time—in acceptable condition. No refunds will be issued for breaches; all payments will be retained by the hirer.
Insurance and Liability
Important: Insurance is void if the driver causes damage while intoxicated or breaking the law.
Third-party property damage cover up to $100,000 is included if the damage cover fee is paid, subject to policy terms.
No cover is provided if the renter is otherwise insured, breaches conditions, or uses the vehicle for hazardous purposes.
The hirer is not liable for mechanical breakdown, theft, or loss of property.
The renter indemnifies the hirer against any claims relating to mechanical breakdown, theft, or offences during the rental period.
The renter is not liable for damage if the vehicle is stolen and used without their consent.
In all other cases, the renter is responsible for damage unless the damage cover fee has been paid, which limits liability to $1,000. If rental terms are breached, full liability applies.
Damage assessments by an independent assessor are final and binding.
Payment and Interpretation
Rental charges—including petrol, pick-up, drop-off, and lost items—are payable at the end of the rental or on demand at the current rate.
Contract terms apply inclusively regarding gender and number for all parties.
For joint rentals, all renters are jointly and severally liable.
